Terms and Conditions - Total Body Performance

Thank you for choosing Total Body Performance as your health provider. We truly appreciate your support and will do our absolute best to provide you with exceptional health care solutions for many years to come. To ensure we provide you and our other valued clients with the best possible care, it is important that you understand and agree to our terms and conditions as outlined below:

1. Be on Time: It’s best for clients to arrive ten minutes prior to their set booked time. Late arrivals may result in a loss of appointment.

2. Bookings Made in Advance: After the initial assessment, if we believe you are a good fit for our clinic, and you agree with our proposed treatment plan, your subsequent sessions will be booked in advance. Future bookings allow you to get the most convenient treatment time and increase the success of your full treatment program.

3. 24-Hour Notice of Rescheduling: All clients MUST accept and agree to our rescheduling/cancellation policy. Failure to attend a scheduled appointment not only disrupts your treatment progress but also limits another patient's progress who may have been able to attend in your place. If you need to reschedule or cancel a scheduled appointment, we kindly request a minimum of 24-hour notice. Failure to cancel prior to 24 hours of your scheduled appointment may result in a charge equivalent to the session cost and/or forfeiture of your appointment as part of your prepaid package. 4. Payment Forms: We accept credit cards, cash, FSA, or HSA.

5. Patient Refund Policy: Total Body Performance (TBP) does not issue membership or package refunds under any circumstances, nor are they transferable. However, TBP retains the discretion and ability to issue credits.
​
6. Automatic Withdrawals (Memberships): By enrolling in a membership plan, you agree to automatic monthly withdrawals. The agreed-upon amount will be withdrawn from your designated payment method every month. The membership term is 12 months, and cancellation during this period is not permitted.

7. Privacy and Data Protection: We are committed to protecting your privacy. Your personal information will be handled in accordance with our Privacy Policy. By engaging our services, you agree to the collection and use of information as described in the Privacy Policy.

8. Changes to Terms: Total Body Performance reserves the right to update or modify these terms and conditions. Clients will be notified of any changes, and they have the opportunity to accept or terminate their agreement.
​
9. Force Majeure: Total Body Performance shall not be liable for any failure or delay in performance due to circumstances beyond its reasonable control, including but not limited to acts of God, war, terrorism, pandemics, government orders, or other unforeseen events.
​
10. Termination of Services: Either party may terminate services under the conditions specified in the membership agreement. Notice periods and other terms related to termination will be outlined in the agreement.

11. Limitation of Liability: Total Body Performance's liability is limited to the extent permitted by law. We are not responsible for any losses or damages beyond what is covered by applicable laws.
